# Terms of Use ## 1. Acceptance of Terms These Terms of Use (“Terms”) constitute a legal agreement between you and CUZ INC. (“Company”) governing your use of the Visual Meditation service (“Service”), a subscription-based streaming platform available on supported devices including Samsung Smart TVs and mobile devices (Android and iOS). By accessing or using the Service, you agree to be bound by these Terms. The Service is provided strictly for personal and non-commercial use. Any use in business environments, public venues, commercial establishments, or institutional settings is strictly prohibited. *** ## 2. Eligibility and Access 2.1 The Service is available only to individuals who are legally eligible to form binding contracts under applicable law. 2.2 Access to the Service requires the creation of a Visual Meditation account. Content browsing is available without logging in, but video playback and subscription require a registered account. 2.3 You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. 2.4 Account sharing across multiple users, excessive simultaneous device usage, or abnormal access patterns may result in access limitation, suspension, or termination without refund. *** ## 3. Subscription and Preview Access 4.1 All content on the Service can be previewed through limited playback functionality. Free users may stream content once per item and access playlists for a limited total duration (e.g., 7 minutes). 4.2 Unlimited playback, playlist management, and full access are available only to paid subscribers. 4.3 Subscription information and promotional messaging may be displayed to users regardless of login status. 4.4 Preview functionality is provided solely for evaluation purposes and does not constitute a free trial. 4.5 Preview and playback limitations may differ by platform and device type. Background playback, screen recording, or casting features may be restricted on mobile devices. *** ## 5. Payment, Cancellation, and Refunds 5.1 Subscription plans are billed on a monthly or yearly basis. Details are provided in the Company’s Subscription & Payment Policy. 5.2 Users may cancel their subscription at any time through their account dashboard or designated customer service channels. 5.3 Refunds are not available once any content has been accessed or streamed, including previews. Exceptions may apply in cases of duplicate payments or technical malfunctions, as outlined in the Cancellation & Refund Policy. 5.4 Subscriptions purchased through third-party app stores (such as Apple App Store or Google Play) are subject to the billing terms and refund policies of those platforms. The Company does not control third-party payment processing. *** ## 6. Intellectual Property 6.1 All content made available through the Service is protected by copyright and other intellectual property laws. 6.2 Ownership of each work rests either with CUZ INC. or the original artist, depending on the licensing arrangement. 6.3 CUZ INC. may hold exclusive usage rights or licenses granted by the original creators and shall exercise those rights within the agreed scope. 6.4 Users may not copy, capture, record, modify, distribute, reproduce, or use any content for commercial or public purposes. 6.5 Any violation of these restrictions may result in termination of access and legal action. 6.6 The following activities are strictly prohibited: * Capturing, recording, or taking screenshots of any content * Uploading or sharing content on social media, websites, or public platforms * Using content in public or commercial venues (e.g., stores, exhibitions, events) * Modifying, editing, or creating derivative works based on the content * Removing or obscuring copyright notices, watermarks, or ownership identifiers * Sublicensing, distributing, or reselling any content from the Service 6.7 The Company may implement watermarking, session-based tracking, or similar monitoring technologies to detect unauthorized usage or redistribution. Violations may result in account suspension, permanent termination, financial claims for damages, and legal prosecution under applicable laws. 6.7 The Company may apply DRM, watermarking, screen capture blocking, session tracking, or device-based monitoring technologies on Smart TVs and mobile platforms to prevent unauthorized reproduction or redistribution. *** ## 7. Modifications to Service and Terms 7.1 The Company reserves the right to update, change, or discontinue any aspect of the Service at its sole discretion. 7.2 These Terms may be revised from time to time. Continued use of the Service after any updates constitutes acceptance of the modified Terms. *** ## 8. Termination 8.1 The Company may suspend or terminate access to the Service for any reason, including violations of these Terms or operational necessity. 8.2 Termination does not affect any rights or obligations accrued before the termination date. *** ## 9. Limitation of Liability 9.1 The Service is provided “as is” and “as available” without warranties of any kind. 9.2 The Company disclaims liability for interruptions, data loss, account misuse, or third-party failures. 9.3 The Company’s total liability shall not exceed the subscription fees paid by the user in the twelve (12) months prior to the claim. *** ## 10. Platform Availability and Feature Differences 10.1 The Service is available on supported Samsung Smart TVs and mobile devices (Android and iOS). 10.2 Device-specific features such as resolution, playback controls, offline availability, background playback, and casting support may vary by platform and device model. 10.3 Certain features may be limited or unavailable depending on operating system restrictions or app store policies. *** ## 11. Governing Law and Jurisdiction 11.1 These Terms shall be governed by and construed under the laws of the Republic of Korea. 11.2 Any dispute shall be resolved in the courts located in the jurisdiction of CUZ INC.’s principal place of business. *** ## 12. General Provisions 12.1 If any provision of these Terms is held invalid or unenforceable, the remainder will continue in full force and effect. 12.2 The failure to enforce any right or provision shall not constitute a waiver. 12.3 These Terms constitute the entire agreement between the User and the Company regarding the Service. *** ## 13.
